Terms of Service
The agreement between the adult who opens an FMS family account and [[LEGAL NAME]]. Please read section 6 on parental authority and section 14 on liability — those are the two that most affect you.

1. Who you are contracting with
FMS is operated by [[LEGAL NAME]] ([[ENTITY FORM AND JURISDICTION]]), registration number [[REGISTRATION NUMBER]], registered at [[REGISTERED ADDRESS]]. In these Terms, "we", "us" and "FMS" mean that company; "you" means the adult who accepts these Terms.

2. Accepting these Terms
By creating an account, installing FMS on any device, or using the service, you accept these Terms and the Privacy Policy. If you do not accept them, do not use FMS.
These Terms incorporate the Acceptable Use Policy, the Refund and Cancellation Policy and the Children’s Privacy Notice. Where a conflict arises, the more specific document governs its own subject matter.
3. Who may open an account
A family account may only be opened by a person who is at least 18 years old and who has full legal capacity to enter into a contract.
Children do not open their own accounts. A child profile exists only because an adult account holder created it. A child cannot register independently, cannot change the family’s rules, cannot delete their own profile and cannot delete the family account.
4. What the service does — and does not do
FMS is a parental supervision tool. It lets an adult set screen-time limits and application rules on devices they own or lawfully control, see aggregated usage reports, assign tasks, and grant rewards in the form of non-monetary in-app units.
FMS is not a safety, security or child-protection guarantee. It does not supervise your child, does not detect danger, does not filter every kind of harmful content and cannot replace your judgement or your attention. Operating systems change, permissions get revoked, devices go offline, and a determined child can defeat some enforcement tiers. Do not rely on FMS as the only thing standing between your child and harm.
Enforcement strength differs by platform and by how the device was set up. We publish those differences on the home page rather than implying every platform behaves identically. Where a tier can be switched off by the child, we notify you instead of concealing it.
FMS does not read the content of messages or email, record calls, capture keystrokes, take covert screenshots, track location or operate in a hidden mode. See the Acceptable Use Policy for why installing covert monitoring on any person is prohibited.
5. Your account and your parent PIN
You are responsible for the accuracy of your account details, for keeping your credentials confidential, and for everything done through your account.
The parent PIN protects every action that changes or lifts a restriction. It is cached on managed devices so it keeps working offline. Because of that, anyone who learns the PIN can lift restrictions on a device without needing your password or your phone. Choose a PIN your child cannot guess and do not let them watch you type it.

7. Stars, family units and other in-app units
- Stars
- Motivational counters granted when an adult approves a completed task. They can be spent on screen time or on rewards a family defines for itself.
- Family units
- Optional counters a family invents for its own use. They exist only inside that family account.
- Coins
- An internal unit associated with a top-up made by an adult account holder, used for in-product purchases where that functionality is enabled.
None of these units is money. They are not electronic money, not a payment instrument, not a deposit, not a security and not a crypto-asset. They carry no cash value, bear no interest, cannot be exchanged for cash, cannot be transferred to another family or to a third party, and cannot be withdrawn. Any balance is a limited, revocable, non-transferable licence to use a feature of the service, not property you own.
Children never spend real money in FMS. Where a top-up or purchase exists, it is available only from an adult account holder and only behind the parent PIN.
We may adjust conversion rates, correct balances that resulted from a bug or from manipulation, and set reasonable limits. If we close or discontinue the service, unspent units expire without compensation; because they were never sold to you for money, no refund arises. Where an adult paid real money for a top-up that has not been consumed, the Refund and Cancellation Policy applies.
8. Paid plans, billing and trials
Some features require a paid plan. Prices, billing periods and what each plan includes are shown at the point of purchase and on the pricing page before you commit.
Subscriptions renew automatically for the same period until cancelled. Cancellation, refunds, trial-to-paid conversion, price changes and the statutory withdrawal right are all set out in the Refund and Cancellation Policy, which forms part of these Terms.
Where you buy through the Apple App Store or Google Play, that store is the merchant of record for the transaction: billing, cancellation and refunds follow the store’s own rules, and we cannot process a refund on the store’s behalf.
9. Additional terms for the Apple App Store
These terms apply when you obtain FMS from the Apple App Store. They are required by Apple and, where they conflict with the rest of this agreement, they prevail for the App Store version of the app.
- This agreement is concluded between you and [[LEGAL NAME]] only, and not with Apple. Apple is not a party to it.
- We, not Apple, are solely responsible for FMS and its content.
- You are granted a non-transferable licence to use FMS on any Apple-branded product that you own or control, as permitted by the App Store Terms of Service.
- Apple has no obligation to provide any maintenance or support for FMS.
- If FMS fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to FMS.
- We, not Apple, are responsible for addressing any claim by you or a third party relating to FMS, including product liability claims, claims that FMS fails to conform to a legal or regulatory requirement, and claims under consumer protection or similar legislation.
- We, not Apple, are responsible for the investigation, defence, settlement and discharge of any third-party claim that FMS infringes that party’s intellectual property rights.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Apple and Apple’s subsidiaries are third-party beneficiaries of these App Store terms and may enforce them directly against you.
10. Acceptable use
Your use of FMS is subject to the Acceptable Use Policy. Breaching it is a breach of these Terms and may result in immediate suspension or termination.
11. Intellectual property and your licence
FMS, including its software, design, trade marks and documentation, belongs to [[LEGAL NAME]] or its licensors. Nothing in these Terms transfers ownership to you.
We grant you a limited, revocable, non-exclusive, non-transferable licence to install and use FMS on devices you own or lawfully control, for personal family use, in accordance with these Terms. You may not resell it, sublicense it, use it commercially, or use it to build a competing product.
Content you create in FMS — task names, family unit names, avatars, notes — remains yours. You grant us only the licence we need to store it, display it back to your family and operate the service.
12. Availability, changes and beta features
We aim to keep FMS available but do not promise uninterrupted service. Maintenance, platform changes, network failures and factors outside our control can interrupt it.
We may change, add or remove features. If a change materially reduces what a paid plan provides, we will give you reasonable advance notice and you may cancel under the Refund and Cancellation Policy.
Features labelled beta, preview or experimental — including the desktop builds while so labelled — are provided as-is, may be unstable, and may be withdrawn. Do not rely on them for anything that matters.
13. Suspension and termination
You may stop using FMS at any time and delete your account from within the app or via the account deletion page.
We may suspend or terminate your access if you materially breach these Terms or the Acceptable Use Policy, if we are required to by law, or if your use creates a risk to other users or to the service. Where the law permits and the circumstances allow, we will warn you first and give you a chance to put it right. For a breach involving covert monitoring of a non-consenting person, or the safety of a child, we may act immediately.
On termination, your licence ends, managed devices are released from supervision, unspent in-app units expire, and your data is deleted as described in the Privacy Policy.
14. Disclaimers and limits on our liability
To the extent permitted by law, FMS is provided "as is" and "as available", without implied warranties of merchantability, fitness for a particular purpose or non-infringement.
We are not liable for what a child does or is exposed to while using a device, whether or not FMS was running, whether or not a limit applied, and whether or not a restriction was successfully enforced. FMS is a tool that assists your supervision; it does not assume it.
To the extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, nor for loss of profit, data, goodwill or opportunity.
Our total aggregate liability arising out of or in connection with the service is limited to the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, or (b) EUR 50.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded — including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or any mandatory consumer rights you have under the law of your country of residence. If you are a consumer, your statutory rights are unaffected by this section.
15. Your indemnity to us
You will indemnify us against claims, losses and reasonable costs arising from your breach of these Terms — in particular from a claim that you installed FMS on a person or device you had no lawful authority to supervise, or that you did not hold the parental authority you warranted in section 6.
16. Changes to these Terms
We may update these Terms. For a material change we will give you at least 14 days’ notice by email or in the app before it takes effect, stating what changed. Continuing to use FMS after the effective date means you accept the new version. If you do not accept it, you may stop using FMS and delete your account; where you have paid for a period that extends beyond the effective date, you may cancel and request a pro-rata refund for the unused part.
Each version carries a version number and effective date at the top of this page. Superseded versions are available on request from [email protected].
17. Governing law and disputes
These Terms are governed by the law of [[GOVERNING LAW COUNTRY]]. Disputes are subject to the exclusive jurisdiction of [[DISPUTE FORUM]].
If you are a consumer, this does not deprive you of the protection of the mandatory consumer law of your country of residence, and you may also bring proceedings in the courts of that country.
Before starting formal proceedings, please write to [email protected]. Most disputes are a misunderstanding about how a feature behaves, and we would rather fix it than litigate it.
18. General
- If a provision is found unenforceable, the rest continues in force.
- Our failure to enforce a provision is not a waiver of it.
- You may not assign this agreement without our consent; we may assign it in connection with a merger, acquisition or transfer of the business, without reducing your rights.
- These Terms, together with the documents they incorporate, are the entire agreement between us about FMS.
- This agreement is published in English, Russian and Spanish. Where a translation differs in meaning, the English version governs.
